response for smog check...somebody help me pls!!!?

I've sold my (BMW Z4 2003) to a person 3 weeks ago. We went to DMV together and transfer the title to his name and success(but something show on his registration: something like he needs pass smog check in 60days) . He come to me today and says: he failed smog check (I passed on May) his friend and he told me that:" you still have the response to take care the smog check." So he goes with me next Monday to pass smog check.

My questions are: 1. I sold already and transfer the title success. Why I still have response?

2. I sold to him 3 weeks ago. If he broke this car?

3. He says If the smog check fail again he will return the car to me. I must accept it or what?
4. He says If the smog check fail or I am playing trick. he won't let me going easy. Just let him ****** up or what?

"When you sell a vehicle in California, the seller is responsible for getting a smog certificate prior to completing the sale." First source, from the California bar. Failing that, you probably still have the responsibility to get it to pass smog or the sale is invalid.



The seller needs to give you enough access to the car to make it pass smog - the cost is out of your pocket.

I believe the law in California states that if you sell a car, it has to have a smog certificate not older than 90 days. Since May is further than 90 days, you may have to take the car back and refund his money if it won't pass a smog check. You broke the law, and are responsible for this situation.

in case you offered the motor vehicle "as is" and with out guarantee do no longer concern approximately it! you do no longer say what jurisdiction you're in so that's complicated to tell which rules persist with. My concepts are merely an opinion.
