What is a wrecked car?

So my car was towed at my apartment complex and under the reason of being inoperable and wrecked and derelict. My car was recently in an car accident and the otter driver was at fault, he rear ended me and broke my back window and broke my rear and my trunk. I still drove my car and it was still able to operate it just looked bad from the back. So what is a wrecked car? One that is COMPLETELY destroyed and cannot run? Cause I will go up to the towing company and call 911 because they illegally towed it.

A wrecked car is one that has been branded ether salvage or irreparable. If it possess none of those it is said to be unbranded. Irreparable can only be used for parts, salvage means it must be repaired and inspected before it can be put on the road, unbranded drive it where you will.

A broken rear window or a smashed back end do not render a car to the salvage or irreparable categories.

you need to look at your lease or separate rules for the apartment complex where you live...........most places I've managed have a rule that would have a car with the amount of damage you described towed as an eyesore.

You say the other driver was at fault, and since only the insurance company can determine fault that tells me it has been settled or is in the process of being settled.



As to it being towed, read your lease/rental agreement or ask the property manager.



Towing company don't just tow a car because they want to. Police ordered it towed or they apartment complex has a contract with them and asked it be towed.



Feel free to go to the tow company and dial 911, but it isn't going to help you.

inoperable is the key term here like say for instance if your car got hit but it only scratched the bumper but some how caused a fuel leak your car would considered

inoperable because of the leak , more than likely it was deemed inoperable because of the broken back window which could be dangerous if road debris was to fly in and hit the driver or something flue out of the window and hit another car

It may have to do with the broken window. Check with the police department. I lived in a city that had a law that a vehicle with a broken window was considered a public nuisance and therefor towable.

A car that is not street legal. Where you live, the apartment complex might have a written rule about wreck cars in the parking areas. A neighbor who had the same issue when through this with the HOA over their wrecked car in the parking area. Then, cops ticketed the car when they left it on the side of the street.Then and only then did the car owner get the thing towed to the junk yard.

You're leaving a whole lot of details out of your question, and there is a reason you're leaving them out. Since cars don't get randomly towed away in any jurisdiction, why was a tow truck called to tow your vehicle? And since towing companies don't tow vehicles without authorization, who authorized the tow? How much damage was done in this recent accident? Which insurance companies were notified? And most importantly, what makes you think your vehicle was simply towed at random?



You don't want to answer those questions, do you?

If it's still operable, it should not have been towed unless the landlord maybe saw it as an eyesore. The driver at fault should have paid to fix your car. If he was not insured, report this to your attorney general. The law says you MUST have insurance.

Not if the landlord has the right to remove non street legal cars, broken back window is almost for sure not street legal. You may need to get repairs or a different vehicle, check your lease, check the law in your area for what is street legal.

Sounds like a scam. Towing companies are notorious for shady activity. The apartment complex and the towing company probably split the proceeds.

A wrecked are has different meanings:



- In the insurance business - a wrecked car is a vehicle that would cost more money, then the vehicle currently costs.



Ex - A $5000 Buick Century requires $5600 in repairs.



- In the Police business - a wrecked car is a vehicle that no longer has all the Safety related devices in operation.



Ex - A vehicle that does not have rear brake lighting.



As for - "Cause I will go up to the towing company and call 911 because they illegally towed it."



Note: The sole purpose of government and its Agents/Officers is to secure and protect the property of man.



Also, government Agents/Officers DO NOT have rights, as they exchange their rights for duties, responsibilities and obligations, of which outline their limited 'authority'.



You do not care what 'authority' they have, BUT you only care about what 'right' they have.



Use this wording instead, as it applies to law and NOT legalese:



You go to the Police Station to file a claim (NOT a complaint).



Note: Always write in the present tense because it is continually happening to you.



You will claim that the man who acts as a Tow truck operator, do take off and carry (NOT stole) your property (NOT your car).



This man (Tow truck operator actor) interfered (NOT violated) your rights and you require (a demand by authority & by right) the immediate restoration of property (include a picture of you car - as an exhibit).



Note: There paperwork will read complaint and they will inform you they can only take complaints, but this is false.



A claim is where you KNOW what happened in your matter VS a complaint is where you are GUESSING about what happened in your matter.



Ex - Your watch is taken.



If you see the man take off and carry watch, you will make a CLAIM that the man is to return your watch.



If you see your watch is missing, you will make a COMPLAINT that the Police are to look for the man and have him return your watch.



Finally, your property (the car) are yours, as such - you are NOT to pay for the return of property, they will try to make you pay.

Most apartment leases contain a clause that forbids junked or inoperable cars from being parked in the apartments parking lot. This is done so the place doesn't get to be looking like a junk yard. If your car was actually operable and road worthy, it may be that the apartment management acted too soon when they had your car towed. I suggest that you go to them ASAP and explain. Remember though, that management has the right to tow your car if they want to and there is little you can (legally) do about it. Most reasonable people would deem a car wrecked and inoperable if the rear window was broken out and the rear of the car showing damage such as you describe. This is why I suggest that you have a calm, talk with management and explain.

Knowing about the "No junker cars allowed" rule, you could have/should have notified your apartment manager about your car immediately after your car was damaged.

you may still be driving the car but if it looks bad it can be declared wrecked With no window I would say they had the right to tow it away. Did you have full coverage insurance? Was it the other guys fault? You need to get it figured out with your insurance company.. Your apartment complex must have a clause in your lease about wrecked cars. They are the onesa that had to call and have it towed talk to them.

You need to learn the laws for your place.



You will find that the towing company can steal cars and make money.



If you get into a legal fight, you will find that the government authorizes such behavior, and they will defend the behavior of such towing companies.



My one question to you is: was your car parked on a public street or other public place? Because if it was, all the car laws apply. If you park in your driveway at home, or on private property while at work or shopping, then less laws will apply to you and your situation.



Every day that your car sits in the "storage" yard of the towing company, you'll be responsible for paying storage charges before they will release the car to you.



If you leave the car there for perhaps 21 days, they will have the right to sell it.



If you have personal possessions in the car, go get them now, or you'll lose them too! Bring proof of ownership of the car (the title) and your driver's license.

So yes, they were correct is labeling your car as 'wrecked'.

They were wrong on labeling it as inoperable.

They should have given you a 24 hour notice that was attached to the vehicle before towing. If they did not, then feel free to call the police.



In my apartment complex, any car that sits for more than week gets a towing warning. It is a neon orange sticker that is applied to the windshield, letting the owner know that if they do not contact the front office it will be towed in 24 hours. They have to give you a 24 hour warning, but it also depends on what it says in your lease. Your lease should go over what is and is not ok to be parked in the lot.

Your lease most likely mentions that the mgmt does NOT want junky cars parked in the area. Gives the whole property a seedy ghetto look. You can get the car repaired or move elsewhere.

Unfortunately, when you park in an apartment complex, you are subject to the policies of the landlord. If he doesn't want some derelict, beat up piece of crap parked there he can have it towed. Get your car fixed or it's liable to happen again.
