i got the ticket and yet she hit me as she was driving on the median-as she was bypassing stopped cars waitinf for the light to change to green..i was pulling out of a side road going the opposite direction...the ideling cars waiting for the light to change..let me go thru as i approached the median..bamm ~!!! this women hit me..the cop says its my FAULT.?? should i fight this ticket? i;m not sure what to do..let;s face it if the cops on her side..i got the ticket..am i just out of luck??

You got a ticket for failing to yield the right of way. Whose was at fault for the accident ? Who will be found liable? Only the involved insurance companies can do and will determine that. Simply report the accident to your insurance company and allow them to do their job.



The ticket you received may not have any effect on who will be found liable (although it is not a good sign)

The officer is not "on her side"--he is just following the law.



".....i was pulling out of a side road..." And in so doing, you had an obligation to not do so unless the way was clear. Hitting a vehicle, or being hit by a vehicle is prima facie evidence that the way was not clear. The fact that she was driving on the median and passing other cars doesn't change that law.



Bottom line, the officer was correct giving you a ticket for failing to yield. You can fight it if you like, that's your absolute right to do so, but chances are you will lose.

You were pulling out of a side road without yielding to oncoming traffic. Of course you should have gotten the ticket. Just because the other cars stopped to let you out doesn't mean the other car was obligated to do so. And make sure you contact your insurance company so they can pay for the damages you caused to the other car.
